Digital Platforms and Global Law (Hardcover): Fabio Bassan Digital Platforms and Global Law (Hardcover)
Fabio Bassan
R2,536 Discovery Miles 25 360 Ships in 12 - 17 working days

Digital Platforms and Global Law focuses on digital platforms and identifies their relevant legal profiles in terms of transnational and international law. It qualifies digital platforms as private legal orders, which exercise the legislative, executive, and (para)jurisdictional power within them. Starting from this assumption, the author studies the relationship between these orders and state, transnational, and international orders. The book first explores the reasons for the inadequacy of the current regulatory matrix and goes on to detail the need for a new paradigm; a shift from the current matrix of market regulation to one of negotiation. The author then examines the lack of effectiveness of current tools and explores how better versions, tools of uniform law, are emerging. This unique exploration will appeal to governments, regulatory authorities, digital platforms, businesses, and students and will find further audience with policy makers and practitioners.

Research Handbook on Sovereign Wealth Funds and International Investment Law (Hardcover): Fabio Bassan Research Handbook on Sovereign Wealth Funds and International Investment Law (Hardcover)
Fabio Bassan
R5,406 Discovery Miles 54 060 Ships in 12 - 17 working days

This Research Handbook is quite timely in its broad coverage of most, if not all, main aspects of SWFs, which have become such important players in the international investment arena. Thanks to the contribution of specialists with a diverse background in law, taxation, international economics, relations and governance, this book offers a comprehensive picture of their structure, functions, governance and practices. The analysis includes the impact that SWFs have both in individual host states where they invest and as agents of development in the global economy.' - Giorgio Sacerdoti, Bocconi University, ItalyResearch into the role of sovereign investments in a time of crisis is still unsatisfactory. This timely Research Handbook investigates the juridical foundation of sovereign wealth funds and investments and extends our frontier of understanding in this important area. Current research surrounding sovereign wealth funds is focused on investment flows and trends that are grounded in economics, neglecting to consider the role of law and governance in the investigation. From a legal perspective, the Handbook narrates a 'passive' side of sovereign wealth funds and state owned companies, exploring how and to what extent the legal constraints imposed by host States act as barriers to investments. Additionally, the active side is also discussed and the influence of ethical principles, treaty re-negotiations and sovereign immunity practices on state investments considered. A comprehensive reference on a complex area of research, the Handbook will be a valuable addition to the library of scholars and students interested in investment law, central banks, international economics and governance. The Law of Sovereign Wealth Funds (Hardcover): Fabio Bassan The Law of Sovereign Wealth Funds (Hardcover)
Fabio Bassan
R2,898 Discovery Miles 28 980 Ships in 12 - 17 working days

This book provides a definition and classification for Sovereign Wealth Funds (SWFs) and discusses its phenomenon within the law context. It identifies the rules applicable to SWFs and to states hosting SWFs' investments. In eight extensive chapters, Fabio Bassan considers whether SWFs may enjoy immunity with respect to host state measures, and whether SWFs can use alternative forms of protection in Bilateral Investment Treaties. Written from an international law perspective, The Law of Sovereign Wealth Funds will appeal to students of international business, international organisations, banks and governments.

From Saviour to Guarantor - EU Member States' Economic Intervention During the Financial Crisis (Hardcover, 1st ed. 2015):... From Saviour to Guarantor - EU Member States' Economic Intervention During the Financial Crisis (Hardcover, 1st ed. 2015)
Fabio Bassan, Carlo D. Mottura
R3,552 Discovery Miles 35 520 Ships in 10 - 15 working days

State guarantees commonly function as financial panacea, allowing states to consolidate banking systems and create intergovernmental funds. Rules surrounding state guarantees were relaxed during the 2007-2008 financial crisis, allowing states to use them for financing small and medium-sized enterprises (SMEs) and workers' severance payments. Despite many multi-level interventions in many areas after the financial crisis, from international treaties to EU regulations, no specific regulation has been put in place to control state guarantees. This book addresses the subject of state guarantees in the Eurozone, and questions the stability of the instruments implemented so far by states and by the European Union. Using a methodology combining law and finance, it examines the tools adopted by European institutions and Member States in the EU's evolving institutional context, in order to evaluate the effectiveness of the tools themselves as well as of the new European institutional framework. It also addresses the unconventional measures adopted by the European Central Bank, its role as safeguard for European state guarantees and its interaction with the European Union and national courts. In From Saviour to Guarantor the authors suggest that the absence of specific regulatory interventions and the variety and vagueness of existing rules has resulted in state guarantees further destabilising public international finance.
